MAECHANICS LIEN -

Mechanics lien is a claim against the real property on which the claimant has contributed labor, materials, services or other value for the improvement of the real estate property. Anyone is entitled to can file a mechanics lien and this includes properly licensed architects, engineers, surveyors, and contractors. A mechanics lien is filed when a contractor, after performing such improvements to the property was not paid in full by the owner of the property. Mechanics lien is filed to notify the owner, the mortgage holder, and prospective purchasers that there is a claim against the property. Mechanics lien prevents the owner from selling the property without first addressing the lien claimant's payment. A properly filed mechanic's lien can ensure the lien holder is paid before a mortgage holder if the property is sold or foreclosed upon.
